ALR HEARINGS:
If your license is suspended, you have a
right to an Administrative License
Revocation Hearing (ALR). You must
request it within 15 days of the date you are
notified of the suspension.
For DWI's, your license is suspended 90
days if you fail a breath/blood test. It is
suspended 180 days if you refuse to take
the test.
Failure ALR Hearings: When someone
fails the test, the hearing covers the
following:
(1) If there was reasonable suspicion to
pull over the driver, and if there was
probable cause to arrest the person; and
(2) If the person actually had 0.08 or greater
concentration of alcohol.
Refusal ALR Hearings: For a refusal case,
where the person refused the breath/blood
test, the hearing covers:
(1) If there was reasonable suspicion to pull
over the driver, and if there was probable
cause to arrest the person; and
(2) If the officer had probable cause to think
the person was driving while intoxicated in a
public place; and
(3) if the person was put under arrest and
then actually asked to take a breath/blood
test; and
(4) did the person actually refuse to take the
test.
